Protection of Persons Restricted in their Freedom

Police Cells

In police cells, arrested and detained persons and persons brought to the police station are kept. They are therefore places where persons restricted in their freedom are present. The Public Defender of Rights not just performs systematic visits to police cells but he can also investigate specific complaints about treatment during the placement in a police cell or about any actions of the members of the Police of the Czech Republic but not about their procedure as an investigative, prosecuting and adjudicating body since the procedure of investigative, prosecuting and adjudicating bodies is explicitly excluded by law from the powers of the Public Defender of Rights. 

Legal regulation of the treatment of persons in police cells follows from Act No. 273/2008 Coll., on the Police of the Czech Republic, as amended, and an internal executive regulation, i.e. a binding instruction of President of the Police. In evaluating his findings, the Defender also relies on the provision of international covenants and the judicial decisions of the European Court of Human Rights.

Systematic visits to 19 police establishments with 110 cells in total were made already in 2006 and follow-up visits were made to 4 of the establishments. In 2010 visits were made to 34 police establishments with 126 cells. Since 2011 systematic visits to police cells have been continuously conducted and the Defender also issued a list of basic recommendations, which is presented to the staff during the visit.

The Defender repeatedly discovers that persons confined to police cells are not advised of their rights, that the written notification advising them of their rights and obligations is not left in the cell and that they are not advised in a clear manner of the right to legal aid, medical examination by a doctor of their choice or of their right to notify a third person of their confinement.
